3. Limitation of Liability

SmartMSDS.com, its owners, operators, affiliates, and partners shall not be held liable for any regulatory penalties, injuries, damages, losses, or operational consequences arising from:

• use of the generated SDS
• inaccurate or incomplete hazard classification
• incorrect chemical data
• regulatory non-compliance
• business losses or penalties due to reliance on the document

You agree that you use the Service at your own risk, and that SmartMSDS.com shall not be liable for any direct, indirect, incidental, or consequential damages.

4. Refund Policy (No Refunds)

4.1 Single-Purchase SDS (Digital Goods)

All SDS documents generated through SmartMSDS are digital goods delivered instantly.
Once generated, SDS files are non-refundable under all circumstances.

If a document contains technical errors, missing sections, or system issues, SmartMSDS.com will re-generate or correct the SDS at no additional charge.

4.2 Subscriptions

All subscription fees are non-refundable once charged, regardless of:

• whether any SDS quota was used
• user mistakes or account misconfiguration
• business or operational changes

Users may cancel at any time to stop future billing cycles.
No partial, prorated, or mid-cycle refunds are provided.

5. Intellectual Property

Upon purchase, users receive a non-exclusive, non-transferable license to use the generated SDS for business operations. SmartMSDS.com retains ownership of the underlying AI models, templates, generation logic, and all intellectual property.
